What is the name of your state (only U.S. law)? WA. State

Another AP but this one is dealing with 2 NON Conforming lots in the City Limits, They probably have a good case but the City says they would not allow a Boundary LINE Adjustment because both lots are considered Non Conforming You can not make a Non Conforming lot More Non Conforming this is in the RCW,WAC,Zoning Codes Would this stand up in court. The City would like to be Named in the suit they are against it.

Nonconforming lot(s)-also has to due with the shape and size of the parcel, not just the zoning. A zoning variance is often passed if it is in the areas best interest -and applies towards highest and best use.:)

It's an interesting question, but really more related to municipal versus state authority. Generally municipalities cannot enact laws/ordinances that supersede state law unless they have express authority by state statute. That's what they appear to be doing here, which is overriding WA law on adverse possession by saying, essentially, our zoning laws prohibit the adverse possession of certain lots deemed non-conforming under our zoning laws.
