Boundary line dispute

What is the name of your state? NYundefined
We own a home very close to our nieghbors. Niether property has ever been surveyed and MANY years ago were both owned by the same family. Over the years both properties were sold numerous times, without any surveys. We believe that the other house is encroaching our property by about 30' according to the tax maps. That property is now for sale but for much more than we want to pay for it due to the conditions, etc. The current owner bought it on tax sale, so has only a quit claim deed and doesn't know anything about the boundary dispute other than what we've told him. Which of us would need to prove there is a boundary dispute? One of us would obviously need to have our property surveyed, but which of us is legally obligated to do so? Does he have to do it before he can sell it?

**A: no, he can sell the same way he bought; without a survey.
