Can I put in the boundary fence alone?


What is the name of your state (only U.S. law)? CALIFORNIA

I don't like or communicate with my next door neighbor. He's a hateful and hate-filled man.

LONG STORY, SHORT: He started and kept a feud going with the man living in the other side of this building (this is a duplex property) because that man is gay. The hateful neighbor would harass him, yell obscene names at him when he saw him, cut branches from our trees and throw them over the fence onto our property, pull up flowers from the front of our yard, etc.
I don't want anything to do with this guy.
The fence dividing our property is falling down/apart (it's very old and made of wood). Hateful Neighbor has tried to get us to pay his brother to put up a new fence. We don't want to cooperate with him on anything, much less give our money to one of his family members.

Can we put in this boundary fence all by ourselves, choosing the materials of the fence(we want something longer lasting than wood) and the contractor or do we have to get the neighbor's consent and approval on everything before proceeding?
We'd like to take care of this eyesore fence without dealing with this neighbor, but we're concerned about him suing us, and having to take down the fence if he wins.What is the name of your state (only U.S. law)?

Assuming you comply with all zoning laws and other regulations about fences, you may put a fence anywhere you like on your property.
