| Common wall encroachment What is the name of your state? New Mexico
I am buying a residential property in a subdivision that has common walls between the lots. The wall on one side of my lot is shown on the survey to encroach 7 inches onto my neighbor's lot. Apparently the wall should have been built on the lot line but was not. This may have been the builder's error or may have been done later. Could I have any obligation to pay the total cost to move the wall if the neighbor wanted it moved? Since it's a common wall, wouldn't we have to share the cost of having it moved? Looking at the neighbors yard, it appears that there would not be much advantage to them to move it, and would cost them a considerable amount of money if the cost was to be shared. Should I worry about this or just forget about it? The neighbor may not even know about it so I don't want to approach them about it. However, if I got a new neighbor who was less friendly, could they make a problem out of this? |
