Drainage Easement and Fencing


What is the name of your state? New York

Ok I am in the process of purchasing this house in Alden, NY and got the survey which has two problems.

1. The storm water drainage pipe is running outside of the bounds of the 15 foot wide easement area. The pipe is completely on my property, but is it a problem that it is slightly outside the easement area even though its still on my land?

2. There is an enclosed fence on my back yard and the fence is short of the property line on two sides, which basically means they fenced in my yard smaller than it is. Does this mattter? I dont really care but would anyone else?

This property is a foreclosure and therefore I am sure the seller will be willing to offer nothing in correction of this. Thank you in advance.

Ask your city health department.

you will care when your neighbors file an Adverse Possession lawsuit and "Take" that part of the land not within your fence.

So do you have any advice about the fence? Should I take it down?

That is a personal decision. You can negotiate with the owner to credit the purchase price minus the cost of relocating the fence but ultimately, you are the one who will have to weigh the cost versus benefits.

I dont understand your previous answer, why would the health deparment have anything to do with a storm pipe?
