What is the name of your state?CA - The only access to our property of 1-1/4 acres is a paved driveway. The house and driveway are about 35 years old. The bottom 100' of our driveway actually belongs to the neighbor's property. There has never been a legal easement drawn up. We have owned the house for 7 years.
1. Is there a right of use easement?
2. After so many years does it become a legal easement? or
3. Can the homeowner next door insist we move our driveway at any time and take back the property?
It is not a landlocked property as there is another privately maintained road that runs in front of our house that we access our driveway from and is accessed by other properties down the street.
