We purchased a piece of land (parcel A) that was originally part of a larger piece. The owners subdivided and sold both pieces (A and B) seperately. Parcel A needs access through parcel B for both physical access and utilities. An easement was signed by the original owner of both pieces and the easement is dated the same date as the warranty deed of parcel B's sale. The sale of our piece (A) is dated 6 days later. Parcel B's sale was recorded with the county on June 14th, but the easement and Parcel A's sale was recorded on June 30th.
We are building a house on parcel A. Our gas company told us that they will not run the gas line at this time because the record date of the easement took place after the sale of Parcel B. At this time, parcel B only consists of a wooded lot and a gravel road. I've contacted our title company (both sales took place through this company), but I just don't know what to expect going forward.What is the name of your state?
