Easements, right of ways, rights & markersWhat is the name of your state? Georgia I live on a street that, within the next 5 years or so, will probably be widened to twice its width or more, taking much of my front yard. I have two questions: 1) Where can I learn what the utility markers in my front yard are? I have some short concrete posts, and some tall ones. Some say R/W, some say V. I believe there is a Dept of Transportation right of way along the front of my property, along with a utility easement (we have power lines alone the front), but I don't know whose is where. 2) Along with whose rights are where, I would like to find out where, in Georgia, I can learn what they (those that hold these rights-of-way/easements) can do without asking. I want to know what my "rights and responsibilities," in terms of these easements and ROW are. Any help? |

| Some times its easy to see whats out there , like the tall green box ( real old ones might be gray or black) telephone, or if theres catv lines it can be green too just marked different. Most utilitys have a call before you dig number call and tell them you want to put in a fence and need to know if theres any underground lines or pipes in your front yard before you do any digging. If theres any thing running out there like say phone co or catv lines they will locate and mark them , If there are none then its pretty simple. Also is the road out front state hwy or county road or just city/ twp road? If its state hwy do not be surprised if underground utilitys get redone and moved back farther away from the road. The call before you dig service can tell you if theres any gas/ water/ sewer/ catv/ phone/ data/ gas / oil / underground power lines out there. Then if you want to search your homes title records you might be able to see if any of the utilitys like catv or phone actually had signed easements from a previous owner. My homes title work had a signed easement granted to the local phone co back when they upgraded from multi party to underground pvt lines and had to run underground for the first time. |
