Encroachment/Damage by Builder

Were two years into this nightmare and just fired our Lawyer who sucked us dry - and not only did not produce ANY results - but made things worse. We are now without representation, scheduled to go to trial in June - and worse - we cant afford another Attorney at this point.

The story in short (its a two year story in its entirety):

Contractor blatantly encrouched on our property, removed 150ft of 15ft tall hedges, and undercut our property causing damage to our driveway.

Contractor has agreed to settle 3 times, each time producing a wild accusation against us each time it came to sign. Our past Attorney was even present at our home at the time of one accusation - so he was able to see first hand the dishonesty of this builder. (This builder has had over 30 lawsuits and is only a two man company) One week after filing suit against them - our car was conveniently vandalized with deseil fuel)

We have many many photos, and emails between ourselves, the building department, and even our Mayor which not only prove our case, but indicate corruption within our building department. We would have filed a suit against the city as well but that is a case of he with the largest legal team wins - and we have no legal team.

I guess the question at this point is that since we cant afford another Attorney and have a trial in June...whats our best game plan? With what we have been through the past 2 years as far as being harassed, and the expense, we wish we had just fixed it ourselves and had never hired an Attorney - and could care less about going to trial..we have had it with this consuming our lives.

Hard to say. Based solely on what you've written, your best game plan is probably to try to settle the case somehow before trial. Unless you want to go down to a library and educate yourself on how to try a case (which is certainly not impossible, but may be time-consuming and frustrating), figure out some way to pay for another lawyer, or try and find some legal-aid service that will help you for free or low cost (may be tough to find if you are a homeowner), you can't just ignore the fact that you have a trial coming up.

See if you can settle the case and put it behind you.
