Question

gating ingress & eagress??


What is the name of your state?State of Florida

I recently purchased 2 acres in a small Subdivision of 6 lots, 3 of the lots are on the main road, from the main road is a dirt road running south between lots 4 (mine) and 5 and then east along side lot 5 up to lot 6. Deed reads that road is for ingress and eagress and also utility easement. Road running South is shown on deed as Item "A" and reads: Item "A" is to be used to access lots 4 (mine) 5 & 6. Portion of road running east on deed shows as Item "B" and reads that Item "B" is to be used to access lots 5 & 6.
Now my question:
South of lot 6 is a lot (not recorded in our subdivision) that has access to and a street address of the road lying south of this lot..owner is now building 2 houses on this lot and is using our road (which County tells me is a private road) for trucks going in and out of his lot. Do we have the right to gate off this road at the main road and show private road signs?? We also belive that he plans to try and use our dirt road as permanant access into the house being built at north end of his lot.

A: Yes, if that has never been declared as a public roadway, then it is still private property and y'all can fence it off.
