illegal subdividing?

We purchased our property almost 13 years ago and up until the day of closing no one, realtors or owners, told us about an "exception" to our property. A 60' wide by 1025.77' strip of property was retained by the first owner of the lot. We were told at our closing that the first owner of the lot (which is 7.72 acres) had an easement through our property at the property line of 60 feet. Now it turns out that the first owner actually owns the 60 foot by 1,025 foot strip of land. We suddenly realize that he owns the land and does not have an easement as it was explained to us at our closing. He's called us to tell us he wants to clear it and put in a road since he has a couple hundred acres that backs up to this strip. The restrictions in our subdivision do not allow lots to be subdivided into less than 4 acres. Is this legal for him to have retained this strip of land. Almost 19 years has gone by since the original purchaser sold the property to the people we bought it from. Is there any way we can stop him from attaching a development to our subdivision? Or from even clearing a road on this strip of land? I would appreciate any input I can get. :(

If indeed this is his own land you cannot stop him from doing any work on land that is his. What you can do is become involved by learning your countys process for subdivision of land and follow the process through. If there are any open meetings required of the owner or developer attend them and ask questions and express your concerns. Your countys zoning offices would be a good place to start seeking information.
