I filed and recorded a survey discription by metes and bounds for an easement.
The survey was done by a state lic. surveyor.
Since this time I have sold the Property.
I applied for a TXDOT Permit and they denied it,
based on their view, that when I filed and recorded it, I did not have a grantor or grantee
conveying the Property? Remember, I owned the Property at the time I had it surveyed
for a Easement.
My question is, does a owner of a property have to dedicate it to someone else or have
a grantee or grantor on the legal discription?
TXDOT says a landowner must sign a dedication instrument to dedicate the easement and then a notary public
must sign to verify that the signature was a proper person to sign that document. Without that dedication instrument, the document is only a valid survey. not an easement dedication. I owned the land at the time of survey, was I to dedicate it to myself?
