There is a small lake that was man made about 50 years ago.

There are numerous land owners around this lake that have been using it for the past 50 years with no problems. Everyone shared the lake for fishing and recreational purposes.


The issue is this... A person bought most of the land around the lake and now owns approx. 80% of the lake bed. He bought this land about 7 years ago. People have continued to use the entire lake with some problems from him. But now he has decided to not allow anyone on his side of the lake. He says it is a liability issue but everyone knows that he is money hungry and is trying to make life miserable for everyone else so they will sell him thier property so he can develop it.

The lots boundaries go to the creek bed in the lake. Which he is trying to establish using a depth finder.

Is there some prescriptive easement or another precedent that has been established that would allow the other land owners rights to the lake.

The person does not own the land that the dam is on by the way.
