What is the name of your state (only U.S. law)? TN

Seriously considering buying 7 acres at tax sale currently landlocked. If we fail to obtain a perpetual easement from an adjacent property owner is an easement of necessity do-able eventhough we bought the property knowing it was landlocked?

From what I could find, TN does recognize an easement by necessity. The problem you will likely have is if the owners of any land you need to cross to access your property disagree and are willing to fight it, it could become a lengthy and expensive court battle. Depending on how the lot became landlocked, you may be required to seek an easement from an owner of an adjacent lot where the costs of creating a roadway are considerable, even if there is an easier way to get to your property through another's land.

we figure to ask at least 2 adjacent owners for a compensated easement....this is an old partition and was left out of the partition survey from 1989. just curious if we can get an easement if they fail to grant an easement. Thank you for your help - this is really a beautiful piece of land and we hope to get it :)
