We own the water rights for the raceway for a small dam pond to a small hydro plant. At one point 40 years ago, a roadway/driveway was built over the raceway(with coverts to allow water flow) for access to a restaurant and campground. The property surrounding this roadway is now owned by a church. The roadway is in need of repair. The proposed agreement would be that the church, restaurant owner, campground owner and water rights owner all pay an equal fee for the repairs.
Who has the responsiblity to repair the roadway? Are the water rights owner responsible for the roadway or do the others have to assure we have water flow(i.e. coverts)?
Can the restaurant owner and campground owner refuse to pay? If they can refuse to pay, do they have the right to say how the project should be done?
