What is the name of your state?Oregon
There is a fence that was built in 1978 seperating our land from the neighbors. The neighbor has not said anything in 27 years. I took down the fence to repair it, and he came down in the middle of the night and took down the new fence stating that it was his property. He has since had it surveyed and some of our driveway is on his property. After 27 years of nothing do I have any recours?

Have you lived there for the years the fence has been up? He may have left it there as it was grandfathered in.. when you removed it, and replaced it, it is technically not repairing it. It is a replacement which he does not have to agree to.

Your best bet would have been to talk to him prior to trying to build it.

If you had the land surveyed and now know the property line, build it on your side. He can not tear it down without just cause (blocking sunlight to his crops, or views of interest).

If he later builds on to or adds to the fence line, he will them be responsible for paying half the costs.
