Natural drainage easementWhat is the name of your state? Tn. My neighbor built a boundry fence on the PL.I ask them not to block the easement they told me it was thier property and they could do what they want.I called the county and they said thier was no zoning laws in the county.Iam worried that when it rains the water will back up onto my properity and cause undermining of my paved driveway or possible get into my house.When i had my driveway paved i had my side of the drainage course reworked so this would not happen.Now that the fence was put up it is pushing the water onto my driveway. I found a declaration of restrictions for our subdivision and it reads. easements: easements for the installation and mantenance of utilities and drainage facilities are hereby reserved along all streets right of way and 7.5 feet on either side of all side and rear lot lines. easements for natural drainage now exist and are reserved as natural drainage courses,and no subsequent purchaser or owner shall obstruct any drainage course.however,drainage courses may be altered,if no obstruction will be created,and with permission or approval from developer. | See if you have an office for Surface Water Management in your county building and land use department. edited to add: you might also check with your state. They should have some type of Surface Water Management office. Some natural drainage courses are governed by the state depending on where (if) the drainage course empties into.
