What is the name of your state? What is the name of your state? Sangamon County IL. My partner and I are gay and our neighbor has an issue with our lifestyle. We have a horse barn and train horses and give riding lessons. Our lifestyle is kept private. There is a private lane that crosses several properties on the north side. Each land owner owns the north 22 feet of the lane. Our neighbor owns the property that runs along the north side of the lane and has not been granted any explicit easement to use this lane. He also has direct access to the main county road on the east side of his 10 acre property. His address is also listed on the main road and not on the private lane. He built a house about 7 years ago on the west side and connected his driveway to the private lane. He has been a nuisance ever since. He has continually driven in our yard and destroyed the turf. On one occasion a lesson customer was thrown from the horse and fractured her neck when the neighbor drove his motorcycle past the pen and revved the motor. After this incident we stated documenting all our issues with the neighbor. He has called animal control over 30 times and even stated our dogs have "viciously attacked him and his dog" This man has no dog and our dogs have never "attacked" anyone. In fact we have many young children around the barn that interact with these dogs. He spent over two hours collecting the dog feces around his property and threw it in our driveway at the front door of our business. He was arrested for this incident and continues to cause problems. We've had a hard time establishing a harassment case. Recently he contacted animal control on a Thursday with yet another invalid claim. Animal control stated there was no violation as was the case during all the other calls. On Saturday when we were gone, our dog was Run Down and killed in our yard. During yet another confrontation with the neighbor he stated "I got one and it's only a matter of time before I get the other three." referring to the other dogs. Last week he was hiding behind a horse trailer trying to coax a twelve year old girl to come talk to him. When her mother noticed something going on, he returned to his property. When she confronted him, he stated he was "Tired of the G#$ D$%# horse people driving in his yard. The mother was extremely irate. Afterwards he called the county sheriff to file a complaint and they stated there was no claim. We believe this was just a CYA move on his part because the mother caught him. There was no reason for him to discuss this with a 12 year old. Each morning he walks down the lane and actually kicks rocks and drags his feet trying to encourage the dogs to bark at him. There are other problems we've experienced. We've been told he still has the right to use our private lane. He would have to put in a 150 yard driveway to reach the main road. The property was used as farm ground and he was accessing the ground from the east end of the private lane until he built his house. We have done a title search on both properties and confirmed he has no explicit easement. This man has a violent history and is a ticking time bomb. We’re finding it to be quite expensive and we’re not getting anywhere. We have cameras up and are constantly looking over our shoulders. If this man has access to the main road can we revoke his privileges from using our lane?

Se you really need to find a real estate attorney who can assist you by reviewing all your propertys documents and then if she/he is satisfied that it can be done doing a letter on your behalf telling him that there is no easement and that he doesnt have the right to use this access . Keep on recording this nut case and get what ever he does on tape to use against him in court .
