Neighbor making false accusations

What is the name of your state (only U.S. law)? TX
My neighbor has twice called law enforcement officers and falsely tells them that we are stealing his dirt to fill in the mud hole at the end of our drive way.
We have about six acres, and we are using dirt from a hole we dug on our land. There has been some heated talk on both sides.

We live along a state highway in TX, this area is part of the TX highway easement, and the area becomes heavily rutted every time it rains, which has happened a lot this year.

He has threatened to file charges. If he does, what kind of lawyer would be best able to represent us?

Document by photos, etc. where you are taking the dirt frrom. If taken to court, have a survey made with location of dirt source certified by a surveyor.

Why is there a dispute over whose land the dirt is coming from? Does he dispute that you own the land, or is he claiming you took the dirt from property undisputedly belonging to him?

At least they contacted the police (proper channels)-
And did not not try to get your neighbors to make statements slamming you in the process.

He's claiming we took it from state-owned land (in front of his property) and moved it to state-owned land (in front of our property).

We are contacting the local TXDOT officer and requesting a blanket permission to continue to maintain the easement (which we will post on the border fence post).

Thank you for your suggestions, I will take date stamped photos the next time we have to repair it.

Where did you get the dirt from?

If you took it from "State owned land in front of his property", you better make sure the land is not actually his, and the State only has an easement. If that were the case, you may be in the wrong.
