What is the name of your state (only U.S. law)? New Jersey

My neighbor approached us about cutting a limb on a tree which overhangs his house (although a healthy limb no where near the roof). We agreed to do this, now he is asking that we have the tree removed b/c the roots are pushing up on his driveway. This is a split tree with half on our side and half on his. We can not determine who is responsible for this tree (the center of the split is on our property). Do we need to remove this tree?

Meanwhile, his entire backyard has trees/bushes over our property line and his house in out of town code for very excessive paint chipping.
