My neighbor's driveway extends 50' into the private road (cul-de-sac). Do any of the lot owners have a right to use their driveway for access (my lot in particular) without a joint road agreement up to the point of the lot lines?

Neighbors Driveway Encroaching on Private Road

WA. The neighbors driveway extends out into a private road area about 50' (cul-de-sac portion) and in order to sell my lot, the realtor says I need a joint road agreement for cheaper access to my property. However, since they extended their driveway in what is considered the private road area (not their property) I'm trying to figure out if I even need to go to this trouble. The original developers didn't clear the road as far as they should have so access to my property would be via the private road to the lot line or create a new driveway from existing private road which is an extra 40"
