Neighbors won't respond

What is the name of your state (only U.S. law)? Georgia

We currently have a house under contract to sell. It was supposed to sell three weeks ago but when the buyer had a survey done it did not match the legal property description. The survey matches the property description of the neighbor's home. The closing attorney had a boundary line aggreement drawn up basically saying our deed is wrong and we are agreeing that their property description is correct. We have been trying to contact the neighbors for three weeks but they won't return our calls and won't answer their door. We finally talked to them once and they said they would have their attorney look at it over a week ago but they still will not return calls. I don't think they have any intention of signing or at the very least having someone look over it. The closing attorney won't close without it. Most likely we are going to lose this deal but what can we do to get this solved in the future if they refuse to even talk to us? Any help is appreciated.

**A: you're basically stuck since you need the neighbor to agree to the boundary agreement.

Hire an attorney, file a lawsuit, get the deeds/descriptions corrected. Not free, but there aren't any other good options.

Surveyor Mistake?

It is not uncommon for a surveyor to survey the wrong piece of property or use the wrong description. Check with the surveyor and make sure he surveyed the correct piece of ground using the correct description. If the surveyor will not accept the possibilty he made an error without checking to make certain, then you have the wrong surveyor.
