We live in Minnesota and bought our home in 2001. Our neighbor put up a fence in 2003 and did not pull a permit. In 2007 we started to clear the brush along the property and our neighbor asked us to stop and wait until a survey was done. We waited.
The survey was completed and found that the neighbors mail box and plantings and fence are on our property. The fence encroaches 5 feet into our property and part of a retaining wall also is encroaching 3-4 feet.
2008 We talked with the neighbor and said the fence is on our land and asked that it be moved and was told it would be taken care of later when more work was done to the property and there was a dumpster on site. The work was done on the home and the fence is still there.
2009 We sent a certified letter (neighbor signed) telling the neighbor we would like all of the encroaching property removed in a timely manner. Nothing has happened. The neighbor took out the survey stakes and seems to have ignored us.
2010 We paid a surveyor to locate the markers and that was completed. The very next morning the surveyors stake was "gone".
What should our next course of action be? Any idea of the cost? We would appreciate any advice**************..
