non-exclusive right-of-wayWhat is the name of your state (only U.S. law)? TX I own 15 acres, about a hundred yard strip(30 feet wide) is a nonexclusive right away on the far side leading to an ex-relatives house. I would like to put up a fence on one side of the easement. How close can I get to the road? It is not maintained by the county and she pays taxes on the easement. |

| You can put a fence right up to the easement, so long as you don't block the easement and fence is on your property. (From your description it sounds like the easement is at the "back" of your property on the edge of it) The only other possible restriction is if there is some county/state ordinance that requires a certain clearance from the edge of even private ways. For example, perhaps there's something that requires a certain width so fire trucks can pass. Even then you may be able to do it, but you have to be more careful. |
