If someone states that they no longer want to be a part of an non-profit organization that they been in for 2 years and wants all of their annual dues and some of the fundraising money back. Can they demand the organization to give it to them.

Sure they can demand ~ they can stomp their feet, stand on their heads too. The organization does not have to comply.:cool:

They have been in the organization for two years already. Why do they think they would be entitled to get back the annual dues they paid for those two years of membership? And what makes the think would be entitled to any portion of the fundraising money if they choose no longer to be part of the organization?

I agree with the other responses. Absent some really compelling facts that are not currently in evidence, the party would not be entitled to any kind of refund of annual dues or money donated, at all.

The money received through the organization's fundraising and donation efforts belongs to the organization.

There are specific rules about non-profit organizations receiving "restricted" funds that have final disbursement requirements to be met, or the entire donation can be forced to be returned to the donor with an outside audit completed to determine the exact use of the "restricted" donation.

If there is nothing written in the organization by-laws, then the state and federal regulations apply as to whether the donation is considered "restricted". Among documents reviewed are board minutes, general minutes, fiscal accounting, single line item accounting, budget, proposals for large expenditures, and other related items.

If the reason the funds are being requested is due to a disagreement over the use of the donation, mediation is part of the process, so a complete review of the situation is advised before making any official decision.
