old fence encroaching on property

What is the name of your state? New Mexico

I am under contract on a property with house in northern New Mexico. The land area is approximately 2.25 acres. The fence between this land and the neighbor is encroaching on the property I am under contract with. So that .75 of an acre of this property is on the neighbors side of the fence. The neighbor appears not to be using this land there and there is only grass on it.

I would like to move over the fence so that I would be able to contruct another house in the back of the lot.

Are there potential difficulties in store for me in moving over this fence. As far as I know the fence has been in place for about 27 years.
