We have been doings some work on a home we own and rent out. Our neighbor requested we remove a shed in our backyard that he felt was causing dirt to push against the common fence - we paid to have it removed. He then requested that we remove some volunteer seedlings that he felt could, possibly, some time in the future, cause damage to the concrete retaining wall in our front yard - we paid to have them removed.

We then decided to remove all the over grown juniper plants in the front yard, and for the time being, put down weed cover and bark. This was a job that was anticipated to take 2 days. It is now in our 3rd week - he comes out into his yard and rants and raves and threatens the workers. He has called the police out to have the Code Enforcement Officer to come out (and we know that is within his right) who did come out and ascertained that the workers are doing nothing wrong - at which point he started argueing with the officer and telling him he does not know what he is doing. He has threatened us, via these workers, yet will not come out and talk to us face-to-face when we are down there. He has sent us 2 emails and left 2 voicemails - and stated that he had been trying to "call all morning" which was not true since we were in and out of the house all that morning, and there is no record of his phone number on our phone.

The workers have had to take some excess dirt from the front yard and place it in the backyard (his initial concern in an email was that we are not willing to remove the extra dirt from the front yard) and will be returning today to grade out that dirt to make sure that it is not threatening the common fence - he has sent us two emails that are not threatening per se, but implied. One of the things he states is that he expects that we will ensure that the bark will not go into his yard (which is nt maintained anyway) because that "would not be acceptable". I am also upset because his actions have resulted in delays which has caused our costs to be $1100 above what we originally were quoted.

One of the questions we have, since his yard is lower than ours, the only way for him to take photos of our backyard is to either come into the yard (and to be fair, as far as we know he has not tried to trespass) or climb a ladder in his yard to look over into ours - is that legal?

Is there anyway we can resolve this besides not lowering ourselves to his level?

We are also concerned that he will start harassing our tenants.

Generally; ignore him. Respond only to situations you cause that are clearly real problems to him now, or may become problems in the future. You are not a fortuneteller, so don't worry about unanticipated problems until they actually occur, then take care of them promptly.

If you take reasonable care, and try to forsee the consequences of your actions, you are doing all that is generally required.
