Power company flexing muscle

Georgia law:

Ok, The power compay wanted an easement to relocate a larger transformer on a peice of property. We bought the tax deed 6 months before the power company filed suit to take the property via eminent domain. However they withdrew the suit, in which we were named, and settled with the previous property owner and he signed off on an easement.

The rights of redemption in ga is 12 months (which expired and the property was foreclosed on)

Since the property has altered since the tax deed was acquired. What should/can we do?

Reviewing how tax deeds work in Georgia, it would appear that they have no valid claim to the property as the previous owner had no interest to convey.

Did you have title insurance?

No title insurance, not yet anyway. At issue is wether they can relocate their high voltage power line on the property- The easement was only to cover a few square feet.

You needed to get title insurance BEFORE such issues come up. You can probably protest that the voluntary easement was given by someone who is not an owner and they'll need to start again with you. Of course, most likely they'll get what they want anyhow. Did the previous owner receive any consideration for giving them the easement?

it doesnt make sense to buy title insurance before you close off the right of redemption,because if the property is redeemed you only get 20% for what you paid on the deed,
