What is the name of your state (only U.S. law)? Texas
I have a delima and need to figure out how to proceed. There is an access/egress easement that has been on the books for almost a 100 years. The easement is about a 3/4 mile long and it owned by 3 owners along the way. But there is one owner that has about 1/4 mile streach and he has tried to maintain it but is inexperenced and got a "freind" to dump asaphalt on it and it has made it VERY VERY bad. He has some spots with 1 foot gullies from mother nature but the asaphalt has made it very bad and virtually impossible to travel with a car. He is not a very friendly person and I know a very cheap person. What should I do? My husband has the equipment to tear out the asaphalt but I fear that could bring retaliation on us. Please advise. :-( I am going to tear up my vehicles traveling this. :-(
