What does pro se mean? this is name under "attorney" in civil protection order suit.

I was going to skip the court date for a civil protection order that my neighbor has filed against me until I spoke w/an attorney today and was told that all she has to do is say I was in her yard and I would be arrested.
Does anyone out there have any info regarding a case like this? We have argued over our propertys. She had a tape player going on last arguement where she was threatening us and my 20 yr old son threatened back.

I looked back over your previous posts and I would think you would want to get this in front of a Judge. If the taped recording shows her threatening you and the son, then I don't see how she thinks that is going to help her.

The neighbor has been trespassing, most likely was the one that pulled the surveyor's stake, abusing the easement agreement..........

Surely you will want to be there to defend yourself and explain what all the animosity is about.

Yes same neighbor that pulled survey stake. Yes her and her sister both argue with us since this has happened. And they both have filed the same charges. They tried criminal charges like I did, but the prosecutor did not accept. Her 2nd plea is on the 21st. She has already plead not guilty but I have a picture of her carrying my stake. I have not said anything to them because I had a dispute 4 years ago with a girl in this city who liked to harass me because I used to see someone that she is friends with. She got so bad that I, who usually am cool headed, got out of my car and told her to get out of hers so we could get "this" settled. She filed assault charges and I went to jail. Well, this neighbor lady found these records, and must have became friends with this trouble maker, because the other day this girl from 4 years ago was at neighbors house. :eek: You can only guess why....
This is why I didn't want to go to court because it will make me look bad.

IMO, it will look even worse if you do not go. I would dress respectfully, stay calm, talk with respect to the Judge, don't be agrumentive with the plaintiff etc...

You should write some notes out on how you will defend yourself with the allegations she will be making. Then practice how you will present them.

We had an identical situation with our neighbor. We have an exclusive use easement on his property (previously our property that we sold to him) for a driveway.
Our neighbor also pulled up survey markers, made threats, and filed a restraining order. We were sure the neighbor would win, bringing his children and girlfriend to substantiate his outlandish stories. The judge pointed out to him that most of his accusations were unbelievable. It took our attorney less than 10 minutes to get it dismissed in court. If we had not fought this RO, my husband would have been unable to hunt, all of his guns would have needed to be surrendered, and we would have been presumed guilty every time the neighbor called the police.
I wish there was some constructive advice I could give on how to deal with the behavior you’re encountering, but we are still not at the point of resolution.
The Judge did state that security cameras are the best investment with neighbors that consistently exhibit threatening behavior. We installed ours promptly, and have had to use them to defend allegations made by the neighbor. When the police explained to the neighbor that we had a tape of the situation from a security camera, it put a complete stop to the false police reports that the neighbor was making.

Thank you Happy Trails, Unfortunately I will get a lawyer. I have no money but I guess Credit Card will work. I have also been hung up on by these neighbors, when I did a *69 it called their house back even though they blocked their number. In our state if you call back a prank call, their phone number will show on your next phone bill even if it is an unlisted #. ( dummys apparently didn't know this) I am taking phone bill. And to tell you how far these people go. I guess their teenaged sons did this, but down the road from our house they painted in the road in large letters with a paint roller, my husbands name and said IS GAY"- They were probably mad because he called her a lesbian in one of their arguements. I took a picture of this too but didn't make a police report ( too embarrassing ).

It appears that we were replying at about the same time. Thank you for your reply. I also have wanted a surveillance but we spent over a grand to put up the privacy fence we thought would stop them from yelling over to our house and making comments, but now they are tearing up the fence by kicking it and climbing on it to look over. My 18 yr old son seen them doing this the other night and walked over to look to see what they were doing and they called the sheriff. My son almost went to jail. By the luck of one nice sheriff they didn't take him. He wasnt' served with papers but she had added that we couldn't have our children harrass them and she said she felt harrassed by him. My hearing has been rescheduled to the 29th of July.

Check on line. they have good, cheap security camera systems out there. Got one for our house (got "bad" neighbors too!) Fight this problem with everything you got.....do not back down, but avoid contact with them as much as possiable. (and pray they grow up :rolleyes: )

Earlier in my posting I said how I had problems with someone over 4 years ago, and my neighbor looked her up on internet and invited her over to neighbors house. Well, now I just found out this &%@#! has now filed a Civil Protection Order against me. The neighbor went to courthouse with her and did all the talking ( I have a friend in courthouse) and I havent' even seen her since the year 2000. How can she do this??????

I am so sorry to hear that there is another psycho out there. There is no limit to what some people will do. I am sure that the tro request will get denied with no contact in 4 years, but that does nothing to alleviate the frustration.
I have learned through the process with my neighbor that there is no justice. We have spent almost 30,000 on attorney fees. We still do not have a resolution. Our neighbor has damaged our property (I have the hit and run report, his is disputing it with his insurance company, no payment 8 months after the fact), verbally harassed our 4 children, threatened contractors, moved survey markers, sent false letters to husband's employer, and he still walks around creating havoc.
Our police department finds him so threatening that they don’t allow the city inspector to visit his home without an escort. The neighbor has more than 10 code violations, including running an illegal business from his home. The city is hoping he will work toward corrections, but really isn’t pushing him.
Our neighbor is in a different economic class than we are, and gets a tremendous amount of sympathy for it. He also has had 4 free legal aid attorneys work for him, but they quit within 30 days when they find out he has lied to them repeatedly. Of course our attorney charges $3000 for letters and phone calls to these attorneys.
We want to buy the neighbors property to get rid of him. He wants 50,000 over assessed value, which my husband is unwilling to pay. We also can’t get the city to confirm that once we take possession of the property that they wont suddenly need all of the code violations resolved. At this point, we are just hoping he makes it to bankruptcy court before October, so we can purchase the property from the bank. He recently took out a sub prime mortgage at 110% of the value with a 12.9 interest rate. The consensus in the neighborhood is that it shouldn’t take more than another 90 days.
You really need to be careful after you win in court at the end of the month. When my neighbor lost, he snapped for a while. He was shooting at our dog, moving his property onto ours, drilling holes in our concrete, and lining his children up at the edge of easement to lean into it as I was driving down it. The police would not assist until we purchased the security camera from home depot ($200 and it is motion activated). In our city, they don’t prosecute unless he admits his behavior or the police view it. It was so frustrating; I was sure my husband going to snap and really make the neighbor happy.

I really wish you the best of luck, and I hope that you don’t let the psycho neighbor affect your health.

Which kind of legal services do I look for when disputing this civil protection order? I spoke w/one lawyer in my town. However, it looks like he is new and from research doesn't look like he has actually finished a case yet. His fee is $750 for this. I was going to look on this forum to find more lawyers however, not sure which to find. Criminal or what?

And by the way. My house is up for sale. Any takers? ;)
