What is the name of your state (only U.S. law)? Indiana

We own our home but the property on the north side of us is a rental.
In the rentals yard there are trees that hang over onto our property directly
over our pool and deck. This causes problems for us year round. The renters
that live there right now are very helpful in trying to keep the trees trimmed as
much as they are able to....but they lack the know how and tools to do it properly.
We do not have any trees on our own propery...nor does the neighbor to our south.
Not only do we have to deal with the leaves, branches and bark falling
into our pool and onto our deck constantly, clogging up our pool filter and sweeper
but we have to deal with the bird crap from the birds in the trees as well. We can't
even use our outdoor furniture without having to clean it first..on a daily basis.
We took the initiative at one point and paid someone to trim the tree
closest to our property.....but the problem has gotten worse over the last
year with the same tree and another that is now hanging over.
Even if we were to have it trimmed so that it doesn't hang directly over
our pool and deck we would still be dealing with the leaves, branches
and bark falling into our pool.

It's something that we have to deal with on a daily basis because so much
falls off of the trees each day...into our pool and all over our deck.

We have talked to the property owner several times about the trees but
she isn't willing to do anything about the problem. At one point she agreed
to pay half the cost of getting rid of the trees completely but when we called
her with the appt date for the removal she changed her mind.

We are to the point now where we are tired of being nice and offering to
go in half for the removal of the trees. Now she has stated that the only way
the trees will be removed is if we pay for it ourselves.

What can we do about this situation?

You are allowed to trim the trees that are over your property. The owners are not required to do anything with/to the trees, unless the trees are damaged or diseased.

**A: pay for trimming or removal. Your choice.

Thank you......

There are actually 3 trees in the rentals back yard...but only
2 of them hang over my deck and pool and cause trouble.

We were told that the tree that doesn't hang over our yard was
diseased around 3 yrs ago when this all started and he said it
wouldn't be long before the others were as well since they are
all in such close proximity to each other. There are less than 6 feet
between each tree. We have already seen some evidence that he
told us to look for...but it's not nearly as bad as the farthest tree as of yet.

He also told us that if the one tree does finally give way that the other
trees would be in danger of shifting or possibly completely coming down
due the root systems of all 3 trees being entwined underground.
