We are having an issue with our shared drive. Our neighbor we share the drive with is selling his property. We run a small home based small engine repair shop and the real estate agents are often blocking the drive way. We often have trucks pulling trailors coming in and out dropping off or picking up lawn and garden equiptment. There has never been an issue till now . Our sign for the small engine repair is very visible and it is also very obvious it is a shared asphalt drive. What can we do ? This is becoming an issue for our customers.

what are the legal enumerated rights each sharing owner has to the drive? Is there anything actually delineating where either party can drive or park?

If not, then a nice request is likely your best action. I would contact the listing agency's broker and ask them if something can be done so the visiting agents are alerted to the fact blocking the drive is causing you issues.

If there are defined rights, then stand on those rights and tell the agents not to park wherever they do not have a lawful right to park.
