Our house, purchased a few years ago, sits higher than our neighbor's. The whole street slopes downward and we are towards the top of the street. There is a small retaining wall, ~3' high, which runs along the length of the neighbor's property, which supports the length of our property. This retaining wall is maybe a foot into the neighbor's property. We have a fence that encloses our backyard which is on our side of the property line.

The neighbor's lot has been purchased by a developer. They demolished the house and will be building a new one in its place soon.

What rights do I have regarding them maintaining or refurbishing their existing retaining wall? It is made of timber beams. In one section the vertical posts keeping it in place are tilted slightly, so this section at least will need to be strengthened and re-positioned.

If they were to remove it completely, the land would inevitably slide downward into that property. The support for our fence would of course be gone. I do not think they would proceed with such an structurally unsound maneuver, but who knows.
