I live in a subdivision that has an apartment complex that was built next to it. My house, along with about 10 other houses, have the apartment complex abutting our backyard. We have a 6' wooden privacy fence acting as a barrier between us and them, the fence belonging to the homeowners, with the "ladder" portion of the fence facing the apartments.

We have had issues of safety with tenants in the apartment complex. There was a daughter of a tenant who broke down 2 slats out of a fence and stole 2 dogs. There was an incident where an individual was spotted trying to climb the fence into a backyard late at night but ran away when they realized they were seen. The homeowners feel that their property and safety are at risk.

We contacted the apartment complex. They are unwilling to work with us to create a safer environment and also to increase the fence height to 10', covering the "ladder" portion or to create another barrier to discourage such events from happening again. They also deny that the potential intruder who tried to climb the fence could possibly be a tenant of theirs but must be a vagrant or other criminal. The apartment complex is a gated community.

The apartment complex has said that we cannot use their property to reface the fence with 10' boards and to cover the laddered portion. They said the only way that we could do that is to climb our own fences to do the work. This is extremely burdensome and would be almost impossible, especially once the 10' slats are installed.

We just want to protect our families and property from anything like this happening again. Do we have any rights to use their property to access ours so that we can build a bigger and better protective barrier from any other possible intrusions? And if we are able to put up a higher fence line, can we then post no tresspassing signs and the sort on that side of the fence line?
