We recently built a house. The builders cleared the trees and brush 3 feet past our property line. They pushed all the rubbish, bushes and fallen tree back and left a wall of debris across the entire back property line that is only 30 feet from our house. It has been 6 months and is still untouched. We bought the space because of the wooded area behind us. When we look out our back door or sit on our patio all we see is an unsightly pile of brush that is 12 feet past the edge of the patio. We asked the builder to remove the brush, and they told us they couldn’t that the area is an easement. There is a steep wooded hill behind us with a house sitting at the top. The person that owns the house said they sold all the property to the builder. Who is responsible for removing the brush from the back of our house?

I would be researching this alleged easement and see what it allows.

I doubt that it allows the dumping of debris on it.

Your municipality may have regulations about such dumping and checking the local regs regarding such may reveal hot-button words/phrases as unsightly or perhaps attractive to vermin and infestation which would bolster a formal complaint.

Oh....and forget calling the builder. Give them one last chance to correct the situation by sending a letter[CM/RRR] that cites the appropriate regs and a request for correcting the situation with a deadline, say 2 weeks.

Do not threaten anything. If there are regs and you cite them by # & title they will get the un-written message.

Phone calls in such situations after say 2 of them with no relief are a waste of time.
