My neighbour's house is located on the hill above mine, and he constantly floods my property as the water flows through the cracks in his retaining wall, goes down the hill and gets into my yard sinking it completely and creating mold on the deck and house walls. My fence bubbled up and cracked from being moist at all times, the area around the poll and pool itself cracked as well. My consruction engineer told me that my pool will collapse as the ground around it liquified and started sucking the pool in, creating more cracks. I contacted Water Department, and was told by them that as at this time there is no water shortage, my neighbour can use as much water as he wants for anything he wants (even if he wastes it), as long as he pays for it. Then I called Department of Building and Safety, and they said that as long as my house hasn't slid down the hill yet, or collapsed, there is nothing they can do. Earlier my neighbour admitted that he had some kind of problem with water leakage, but after I requested on several occasions to correct it, he became reluctant and refuses to investigate or fix the problem. Is there any way I can stop his negligence and save my property drom destruction? Who can I contact about my matter, besides my attorney? Thank you.
