Just purchased home with 6 acres. Deed and sales papers do NOT mention a shared well. Neighbor showed up and said, oh by the way we have a shared well. We knew nothing about this. We believe when house was vacant for last 10 years he helped himself to hooking into it. He has a strawberry, blueberry and hazelnut orchard. I do not want to share a well. Since there has never been anything recorded at the county can we just shut him off. We have NO well agreement. House has been sold few times in last few decades and no agreement at all.

Do you see a second set of electric lines going to the well head ? ( as in one set not connected but still there ?) How close is the well to the lot line ? what about the water pipes from it is there a pipe that connects your home to the well and you still have water if you turn off your electricity at the main? Did you have a boundary survey done that shows this well to be on your property ?

Go back to the title company and see about going back another 20-50-100 years for an additional fee. Forgot what you call this....but it might be helpful and cost you $100-$200.

Do this after checking out farmerJ's suggestions....and you still have a problem.
