Snow falling from roofWhat is the name of your state? Massachusetts. I live in a 2-family condo. Our neighbor's driveway runs along our property line, about 5 feet from the edge of our house. In the winter, the snow from our roof falls onto their property. They feel the snow falls at a rate and quantity that it endangers their property. Prior to purchasing this house, the previous owner had a roof installed that does not allow snow to accumulate on the roof and causes it to fall off. There are approx 30 snow guards that break the snow into smaller portions rather than falling off in one solid sheet. They have told us in the past that we need to do something about the snow on our roof, but we have no solution. The roofing company has been out to evaluate the pitch of our roof and can't imagine that the snow is falling that far out to endanger their property. We have not had them out during a snow storm to evaluate, which I know is the next step. They have had an attorney send us a letter informing us that we need to do something to fix the snow problem. Legally, are we liable for the snow falling off our roof?What is the name of your state? |

| Seems to me, particularly with the breaks, that reasonable expectations have been met, but otherwise, snow seems to me to be an Act of God. If it falls onto their driveway, God meant it to be there. It's not like you've set up something maliciously that will funnel the snow over to their property with any ill intent. Out of curiosity, what remedy, specifically, are they demanding you to implement? |
