What is the name of your state (only U.S. law)? Texas

The neighbor behind our property built a house. We had field fence dividing our property that was paid for by the people that we purchased the property from. When the new house was built we put up a 90 foot long privacy fence about 6 inches from the field fence. The neighbors have taken down the field fence behind the privacy fence and put in a garden up to the new wooden fence. Is there anything that I can do about this?

depends was the old fencing right on the property line? meaning that your privacy fence is bout 6 inch or so on your side of the property line? If this is true the most you can do is make them move the garden back over their line. It could be they think you new fence is the property line and not where the old fence was.

Get a boundary survey done for atleast that side of the property.Have them put in the 2 corner stakes, and then wooden stakes every 10 to 20 feet.

Perhaps you already did a survey when you installed the new fence? It is always a good idea to have a current survey of some sort(not a mortgage survey).

If there is encroachment by the neighbors let them know they need to move things back. Put in a few cemented t posts with wire if you need too.

Having a garden up against your fence will result in water damage.Tell them to move their things or fence them out somehow.Say nothing and you will lose it.

First step is a survey, because what people THINK is theirs often does not match the legal findings of a survey. If they dispitue the results then they will need to hire a professional to survey their property. If the results differ the surveyors will work it out.
