Tree on property line

What is the name of your state? Virginia. I have a tree on the property line between my neighbor and I. Originally my neighbor agreed to split the cost to have it removed. Now he has changed his mind and I want the tree down to put up my fence. 2/3 of the tree is on my property and I would like to know what my options are for resolving the issue of removal.
