Yesterday, we notified the neighbor at 8am that we would have some tree
trimming done on our side of the property starting in 1 hour.
He acknowledged that.
At 9:15 am the tree trimming service guys started their work.
At 11:30 am, a branch fell from our tree. It landed on the neighbor's side.
The neighbor claims that when the trimmer came by to pick up the branch, he
dragged it across and scratched some personal property with was recently
purchased for $3,000.
The tree trimmer will return in the next day or so to finish up some trimming.
The neighbor considers the trimmer to be responsible for the damages.
But he also said that we would be liable if the trimmer did not assume responsibility.
We reminded the neighbor that he was notified (in advance) about the trimming work
and he should have moved his possessions elsewhere. Specially since they were
worth $3,000. So why keep them right under a tree that is being trimmed.
The neighbor responded that he did not know that a branch would fall and result in damages.
Our response was - how do you not expect a branch to fall when you are witnessing
the branches being sawed off for more than 1 hour.
The neighbor is adamant.
If the trimmer won't resolve the problem. He may sue us.
What are our options? Please help.
