Underground Easement?

We are in Georgia.
We recently had to fix a water line on our home and was given permission from the neighbors that we could dig up and install a pipe. We are not sure if it's on our line or theirs, but just being considerate, digging up grass, we asked if it would be OK. If this is on their property, will we need to draw up legal forms and make a claim that it is an easement on their property and then file it with the county? We are in the process of selling the home with in the next month, actually just had a contract on it last night.

**A: the answer is yes, a recorded easement would be the safest route.
