Ebay/Paypal Filing Claim


What is the name of your state (only U.S. law)? Michigan, Detroit

I sold a product on ebay a Blackberry Bold and the the buyer filed a "not as described" dispute with paypal. PayPal decided in favour of the buyer and refunded the money now the product was returned to me but with some physical damages and missing accessories. I told PayPal about it and they told me to file an incident report. Here is where the mess starts. I recently went up to my local police department and tried to file a police report but they refused to do so stating that it is a civil matter and not a criminal matter (which I dont understand). As far as paypal is concerned they just want a letterhead from the police department stating that damage has been done to a product. How can I stop them from giving me the runaround and actually take my report so I can get my money back. I am sure there are a lot of people out there are looking for the very same answer.

Unless the buyer is local, this is your problem. Your local police have no jurisdiction over the buyer and to them, it is strictly a civil matter. You need to file a report with the buyer's local police department.

really!!! the person lives all the way down in NC (north carolina)......talking with paypal they say that they just want a letterhead from the police department......the police should not even do any investigation....they should just take my statement.....why is this so hard?

Because your LOCAL police have no jurisdiction. Call the police department local to to BUYER. It's really not THAT hard.

And keep in mind that you have no authority whatsoever to force any police department to write a letter on its letterhead.

You're lucky you got the product back at all. But how is the police department supposed to know that it came back to you damaged?
