Gaming Company - Banned for an undone misdemeanor


A company that provides a game I pay for has recently banned and terminated my access to their facilities on the grounds that I have cheated in some manner. As I had not, I used the offense appeal system they have in place and was rebuffed, assured that I was the one responsible and that I had indeed cheated.

Regardless of the action seeming, "Childish," I wish to take legal action against the company in question for the defamation of my personal character, as well as the cost of paying for my account over the three years that I have done so.

I would like to know just how fine the eggshells I'm stepping onto are before going any further, however.. hence why I'm producing this post. Any advice and/or help is greatly appreciated.

P.S: Do keep the, "Grow up!" comments under a lid - I reserve my right as a male to never have to do such a despicable thing! Lol!

They don't have to let you play.
You've not been defamed just because they've terminated your account (regardless of what reason).
You've got no legal grounds here.

What you will do if you file some sort of lawsuit (which you will not even get close to a decision in your favor), is fame as a whiny, "you won't let me play, I'm going to sue" snot nosed kid.

It isn't as simple as, "You won't let me play, I'm going to sue!"

Were it a case of that, I wouldn't even bother putting it on a public forum. Quoting their own Terms and Conditions;

Yes, they do not have to let me play, where there is reasonable proof or doubt that I have not been playing the game honestly. As my requests to see such proof have been shot down, then there is a problem. If I hadn't paid for the game, I probably wouldn't care less. But I have. In excess of $500 AUS over the span of the three years. Not a lot, but I'm a rather egotistical individual. The principle of the matter is I haven't done anything to warrant the actions taken against myself, and I'd like to seek compensation or emendation of the mistake.

If you are in Australia, we further can't help you. You obviously also skipped over the terms of these forums (and the fact the board software specifically asks you your state, but you just deleted that because obviously you are one of those who believe the rules don't apply to you).

Don't know what the Aussie courts will do with a whiner like you, but you've got no grounds in the US if you were to be here.

AT ANY TIME and FOR ANY REASON mean just that. Doesn't have to be a good reason or a proven reason.

1) The Aussie courts are similar to the American ones.
2) The rules may very well apply, so if it's any consolation prize, NSW. Sorry that I can't be in America, though, we aren't all just that, "Lucky." I'm afraid my mother was in Australia at the time of my conception, and it seems that she remained. Much like your own mother was simply in America at the time of your own birth. Not even a throw of the die would've picked that one, eh?

3) Regardless of the mannerism in which you answered, you did. And promptly. Kudos and respect for that. Hard to find either of those two traits nowadays.
4) The assumptions of my age going by the references of a, "Snot-nosed whiner," are.. a little off. Not by much, but they're off.

Seeing as this thread no longer serves a purpose, I'll count on a moderator or other such person with the power to do so to lock/delete it.

You never believe any rules apply to you, eh? That's nice. No wonder you're having problems.

You can go buy a battle chest that has the original game and first expansions of World of Warcraft for $30, then you just need to go grab a copy of the new xpac. Until you have the means at your disposal to take on a company as large as Blizzard, you're screwed. Also, either the TOU or EULA (I don't remember which) state that they can ban you at any time for any reason or for no reason at all, just because they feel like it. It also states that your account is Blizzard's property and the only thing your $15 a month pays for is access to their servers, your characters, your hard work, your super awesome whatever... all belongs to Blizzard, not to you.

If it wasn't WoW you got banned from, feel free to ignore my post.
