Getting Our Refunded Money Back

What is the name of your state (only U.S. law)? We are in CA, they are in TX

We ordered a scooter on June from an online company in TX. After 2 months of hearing from them that they were having trouble getting CA to okay the shipment, the order was cancelled. This was a month ago. They promised us a refund, but everytime we talk to them, they say that they're working on transferring funds around, it will be processed soon/was processed/will be processed anytime now. We have filed complaints with the BBB in their area and Google checkout (who the payment was through). We paid with a Visa Debit Card. What are our other options? If we take them to small claims court, would we have to fly to Texas and do it in their arena? Or can we take them to a small claims court here, as they are doing business in this state (their website says they have a dock in CA)?

Still no money back... the company is ignoring us. They're ignoring the BBB. They're telling Google checkout that everything's fine. Our money's still in their hands. It's been 1.5 months since we cancelled the order. They've had our money for 3 months. It would be really nice to know that we'll be getting it back. Does anyone know what state a small claims court suit would have to be filed in? Ours or theirs? Any help or advice would be mucho appreciated!

If you used a debit or check card which carries the Visa logo, you should have the same protection as you would have had had you used a Visa credit card. Call your bank to dispute the charge. Explain the circumstances. Your bank will send you paperwork to fill out regarding the transaction. If/when the bank finds in your favor, the bank will reverse the charge.
