I got a email from GAF

Couple weeks ago I was selling a rolex watch but I didn't know it was fake. Today I got a email from Gibney Anthony & Flaherty demanding me to: "Surrender all Illegal Merchandise in your possession, custody or control", "Provide the Identity of the Source of the Illegal Merchandise", "Make payment to "Rolex Watch U.S.A Inc" by cashiers check, certified check, or money order from all damages and costs incurred by rolex in connection with your illegal conduct, in the amount of 350US.

I was shocked. What do I do? Email them back? I'm a broke student who was selling the Rolex in the first place for money. How am I suppose to the know the watch was fake.

I presume that Gibney Anthony & Flaherty is a law firm?

Are you selling the watch online? How would this law firm even know whether you owned a real or replica watch? Does your sales ad list a serial number of something to identify it?

I'm thinking this could very well be a scam. If it's a legitimate demand, it wouldn't be worded as you indicate. They'd just tell you to destroy the fake watch and ask for your help to track down the source. I sincerely doubt they'd be demanding first thing a payment of ANY money as damages.

I would highly recommend that you give the law office a call to see if the letter and demand are even legitimate and you can go from there. Rather than relying on the number on the correspondence, do a 411 search in the local area and get the actual phone listing before making that call.

Well it was on ebay a couple weeks ago but taken down by ebay. The Email was attached to a PDF file with a signature

GAF is a very real and very aggresive lawfirm. For such a small amount it is doubtful they will sue. I would suggest disappearing into the woodwork for a while, don't sell on eBay, don't reply to emails, basically ignore them. They will basically get what they want, a seller of fakes off eBay.
