if i refuse delivery, can i expect my bank will give me a chargeback?


What is the name of your state (only U.S. law)? Wisconsin (business based out of IL, tickets shipping from CA)

Hey, thanks in advance for any help!

My wife bought some tickets on an online scalper website, and overpaid almost 3x. I contacted the website (ticketsnow.com) literally as soon as I could to see if I could get the order canceled and they said they would get in touch with the guy they're buying them from and then get back with me. Instead of getting back to me they just sent her the email with the tracking number.

I doubt there is any way out of this, but if I refuse to accept the package will that allow me to contact my bank and ask for a charge back? Thanks.

haha so even if I refuse the package I'll be on the hook for the money? I've just read a lot about people refusing delivery on packages from amazon or ebay and getting refunds/chargebacks - I just didn't know how this fell into that realm lol

Ticketsnow will dispute the chargeback to them and they will most likely win. Again, tell your wife to enjoy the event.

I don't doubt they'll dispute the chargeback, but what would be their position if I never took possession of the tickets?

I'll be more than happy to accept my fate, and I guess I am grasping at straws, but I just don't see the logistics behind them having a case. I paid for 2 tickets, and technically I never got 2 tickets.

Would it work out better in my favor if I just didn't answer the door for the FedEx guy so after X attempts it just becomes "autorejected" or whatever and gets returned?

The tickets from places like this are sent with delivery confirmation. That is all the proof needed they were delivered. Depending on how time sensitive the tickets are will determine how hard the seller would fight the chargeback.

The terms/condition page indicated:
2. RETURNS
There are no refunds, exchanges, or cancellations on any request once it is submitted to us. This policy is in place because when you place your ticket request, we attempt to secure and acquire those tickets for you from a ticket supplier and are not able to recover our costs. Please order tickets only after you are certain you want them.

Short of your credit card company carrying its own thirty day money back guarantee for charges, you may be on the hook for this one. ...

this can be done.....but here's the thing that came to mind while i was washing the dishes.


when is the event? will they be returned in time so they can be sold again?

and it doesn't guaruntee a chargeback. wife ordered, they sent them. they did their part of the deal.

has the item already been shipped? can you dispute the charge on the card?

just because you refuse them at the door, doesn't mean you'll get your money back.

You are confusing delivery confirmation with certified with signature delivery, these are 2 completely different things. Delivery confirmation means the item is delivered to your mailbox, the sender is notified, usually through email, the package has been delivered. You don't sign anything.

As far as the seller's tactics, caveat emptor.

1 - if i straight up refuse to take delivery they should be back in time to ship again - the event is the 14th

2 - the item has been shipped - I was actually in contact with ticketsnow and they were supposed to call me before they got shipped, which didn't happen, but they are scheduled to be delivered today

3 - But does refusing them get me a feasible chance of getting my money back? and yes my bank (Wells Fargo) said that if I do not recieve the tickets I can dispute the charge. They said they could dispute the charge now but there wouldn't be much of a case until I didn't get my tickets.

(edit: to expand on #3 - I did mention that I was going out of town so someone would not likely be at the residence to take delivery, and what should I do if they get returned to sender. She said if I didn't get my tickets, she could file a dispute)

I am not looking for an ethics/morality lesson thank you though. Also selling tickets at 280-340% isn't dishonest/morally wrong?

edit: the tickets would be back in the original owners hands quick enough for him to resell them, so I actually hardly find my desire to be that bad -dishonest, slightly - but not something that would keep me up at night


To the point though, can anyone elaborate exactly why "I won't win"

As I said I am willing to concede that we are stuck, but just saying that I am doesn't help me comprehend why.

Because your wife willingly engaged in a legal transaction. She doesn't get her money back now because you've (either of you) have decided that she's paid too much for the item or because she was naive. Seriously, if she's that naive about online purchasing you may want to restrict the credit card access...

Fedex may also leave you a note inviting you to collect the item from their local warehouse/center or - with indirect signature - leave it with a neighbor, building manager etc.

Dude seriously - your wife messed up. Use the tickets. Don't use the same vendor again.
