Jay-z Benefit Resale Ticket value

What is the name of your state (only U.S. law)? I live in CT but the concert is in NY at Madison Square Garden.

Q: Is it a crime to make a profit on a benefit? ex: is it legal to purchase or sell tickets more than the face value? there are online vendors such as stubhub and vivid tickets as well as individual sellers on craigslist selling for well over the face value of $54.

Stubhub and Vivid are licensed retailers and pay taxes on the money they make on tickets, scalpers don't. Scalping is legal in New York, there are not restrictions on how much a seller can ask. Scalping is illegal in Connecticut.

i was under the impression it is not legal to profit on a benefit/charity, does this differ from scalping on regular sporting events or concerts?

"JAY-Z will play a benefit concert at Madison Square Garden presented by ABSOLUT, on September 11 at 9PM ET that will air exclusively in HD and commercial-free on Fuse.

All proceeds from the concert will go towards the New York Police and Fire Widows' & Children's Benefit Fund, an organization that has been helping New York City families of fallen first responders for over 25 years. For more information, visit www.answerthecall.org.

Since its inception, New York Police and Fire Widows' & Children's Benefit Fund has distributed over $114 million to the families of New York City police and fire personnel who have lost their lives in the line of duty. Though the Benefit Fund was initially created to assist families of New York City Fire Fighters and Police Officers, the non-profit now includes the families of Emergency Medical Services and Port Authority Officers as well."

The reason for the concert and ticket sales is irrelevant. In the eyes of the law, it is a concert just like any other, the proceeds are just going to a charity instead of the pockets of the promotor and performer. Once the original seller gets their money from the sale of the tickets, they likely don't care who buys or sells the tickets after that. You shouldn't care either. If your griping because you can't buy tickets at face value, welcome to a free market economy.
