sold a broken camera on craigslist. What is the name of your state (only U.S. law)? Arizona Ok I purchased a video camera for $50 on craigslist. The Listing said the camera works. So when we did the transaction at his house he powered the camera on and and guarenteed it worked. When I got home I Had put in a tape and it had just static as the play back. I even tried the tapes that were included with the camera, recording 10 seconds and trying to do playback I had the same static. I sent an email back to the seller stating I want a refund, and he responded he doesn't do refunds! He said it worked 100% that day. I am now stuck with a broken camera for $50. I printed the listing before he could delete it and it did not state anywhere "as is", "no refunds", "all sales final". Times are tough I want my $50 back no matter what it takes. Can I take legal action(small Claims) or get the police involved? What is the name of your state (only U.S. law)? |

| The problem is that you accepted his proof that the camera worked when the sale was made. You say that the proof may have been no proof because of the way the test was run. The seller says you approved the test and bought the camera. How does the seller know you didn't drop it on the way home while it was your camera? It becomes your word against his word with the fact that you accepted the camera as working.

| The lack of a return policy works against your, most consumer laws require a stated return policy if there is one. This is even more true in a private party sale. Private sales are considered "as-is" unless there is a specific warranty or return policy.

| "No matter what it takes?" I'll tell you what. I am an expert negotiator. Send me the contact information of the seller, along with a check for $500 for my negotiation fee. I will contact the seller, and offer him a $100 reward if he returns your $50. Seller gets $50 for nothing, I get $400, and you get your $50 back. |
