want to get a refund, fight a dispute with seller


What is the name of your state (only U.S. law)? NJ

I have recently purchased something off of *bay and decided to get an exchange from the seller. The original item was paid for via paypal therefore under buyer's protection. I did a second transaction with seller for the exchange, since the price of this second item is slightly higher, so seller only sent invoice to me and the second item was not on *bay but another website.

Received the item, was not as described, wanted to do exchange again, email the seller, seller agreed but regretted. Filed disputes for both transactions on paypal, but lost cuz paypal said they can't do anything about the second item i have since it's not an *bay item, therefore i'm at my own risk.

My question is, can i treat the first transaction as an individual transaction, and not related to the second transaction, and claim that i've returned the original item (have proof) and want a full refund, since this particular transaction is for that item only, and does not mention anything related to second transaction. The first transaction is purely original item on *bay and is returned already. And try to do something about the second transaction, because that was where seller has mention anything about the exchanged item. If I'm not protected by paypal for the second transaction since it's non *bay, will the seller be protected?
But I did email seller about the returning original item for an exchange. I do keep all emails from the seller.

You received the items. Paypal isn't going to say you can have a refund because you changed your mind. You paid, the seller sent the item, case closed.

Any dispute now is between you and the seller and Paypal is no longer involved.

Paypal's seller and buyer protection works for tangible goods both on eBay and off. If they didn't find in your favor, it's because the seller can prove you received the item, ot because it was off eBay.

Last Christmas, I bought a product on eBay that I needed to return. Filed a claim with PayPal, argued my case, and won a full refund.

Sorry, that's the way it ought to work, but it does NOT.

Seller protection policy does not work for "signficantly not as described" disputes. If the buyer files one of these, returns the item with the appropriate electronic confirmation, Paypal will roll over and refund him and debit the seller. Further if the buyer chargesback through his credit card, Paypal will generally roll over as well (unless there is some clear apparent fraud which is rare).

Been selling on Ebay for ten years...that's the way it is.

Recently I bought something not as described by a long shot. I bought some foreign currency, and received children's play money. According to PayPal, I was SOL on that. Enough complaints against the seller and his account could be suspended though. I've been on the buyer end of a dispute like this. They told me that, as I received something, it's a civil matter.
